Divorce

If you have come to the decision that your marriage has come to an end, you may feel uncertain as to the way forward.

If you have children, property or finances which need careful consideration, we will guide you through everything that you need to consider and deliver a holistic approach to Family Law.

To begin the divorce process you must have been married for at least one year before starting divorce proceedings at Court.

You can issue divorce if one of the following five grounds for divorce apply:

  • That the other party has committed adultery.
  • That the other party has behaved in an unreasonable way.
  • That the other party has deserted you for 2 years.
  • That you have lived apart from each other for a continuous period of at least 2 years immediately before the divorce petition is issued at Court and the other party gives their consent.
  • That you have lived apart for a continuous period of at least 5 years immediately before the divorce petition is issued at Court (regardless of whether the other party gives their consent).
